Pretty damning....Hambone....could this be used to hit the seller with a fraud charge? Legally?

Guy must be a huge scumbag in any case....
 
That is proof that the seller is the one who faked it.

Last year I was looking into his User Feedback and the old transactions. He buy a lot barreled receivers and parts, then he is selling complete rifles.
 
Looks like the humpmeister seller beat Ben at Classic to the stock.
 
I'd take screen shots of the auction plus the auction that the seller bought the sporter from. If he was listing it as genuine, then it's fraud. You should report him to Gunbroker and should not receive negative rating for non payment.

Honestly, Gunbroker probably won't do anything against the seller. Technically, the seller didn't lie about the condition. They didn't make any claims that the rifle is all matching. However, they operate in a highly unethical manor trying to pass off turds as something legitimate and are being intentionally misleading by not stating the entire condition of the rifle. Grey blanket also operates in this manner, but I do believe he does not sell forgeries intentionally, just that they're more apathetic to verifying the integrity of the product.
Also, Gunbroker's fraud policy is pretty poor and similar to insurance (i.e. you need to pay GUNBROKER a $100 deductible in order to receive a maximum claim of $500). Their fraud claims process is more oriented towards situations when the buyer doesn't receive the item as opposed to a seller hocking forgeries. I wouldn't be surprised if Gunbroker shut down the buyer's account and did nothing against the seller. GB is a business, and they make money on seller fees. In my opinion, Gunbroker is a pretty poor platform for buyers

You would be wrong on this point, he does absolutely knowingly sell humped, or Mitchell'd type stuff, fully aware, and mis-represents it. I know for a fact based on a rifle I passed on years ago that he bought, and when we talked about it, my buddy and I let him know the issues, and he said he knew. Appeared on GB 2 or 3 weeks later, described as 100% factory original....

I am not saying he dos it with all his guns, or most, or anything like that, but he knows when he is selling something that isn't 100% and says it is....

The old auction when he bought the "duv 42" barreled receiver also wasn't cold and you could clearly see the metamorphose to a matching K98k happened during it was in his property. At that time he described the rifle as completely matching, in the new auctions he's more careful with his words in the description.
 
The seller is a complete turd artist he has two more k98 rifles for sale that are both fakes. A bcd 4 and a byf44. Both have their bolts ground and renumbered and the stocks have fake stamps. Not to mention other remembered parts on these rifles. Seller knows what he's doing and should be added to the list of the known humpers on GunBroker right now.

Such as commonwealth, elitecollection, and dragom. Personally I think there should be a wall of shame on this forum that shows these sellers.
 
Always funny when this happens, usually Loewe bringing the smackdown, but we got a double smackdown from 8x57 too.

Pzjgr, fraud is tough, requiring a high level of proof. In this case it looks like he just said it was a "real" K98k. Real humped ;)

I would agree. Don't take a negative hit; you bid in good faith, and have proof to show to GB that the seller faked/humped the rifle, then mis-represented it to scam a buyer. His bad; and should be reported.
